General Terms and Conditions of Use
These general terms and conditions of use (the ” GTCU “) apply to the Safran Electronics & Defense (” Safran ED “) website located at Home – Safran Electronics & Defense (safran-electronics-defense.com), worldwide (the “Site”). The Site was created by and is the property of Safran ED.
The purpose of these T&Cs is to provide a legal framework about the Site’s services availability and its use by the user (hereinafter ” User ” or referred to as ” You “). In particular, the Site offers the User a support for Safran ED products. The Site is made available to the User solely for his professional needs.
The use of the services of the Site is reserved for Users, natural persons employed by client companies who have acquired products manufactured or sold by Safran ED (the “Products”) and provided that such person(s) have been expressly authorized to do so by the client company concerned (the “Customer”).
BY USING THE SITE, YOU ACCEPT THESE TERMS OF USE WITHOUT LIMITATION OR QUALIFICATION ; IF YOU DO NOT AGREE TO THEM, PLEASE DO NOT USE THE SITE.
Your sole remedy against Safran ED in case of dissatisfaction with the Site is to stop using the Site.
Safran ED reserves the right, at its sole discretion, at any time and without notice, to change, modify, supplement or delete parts of these Terms. It is your responsibility to periodically review these T&Cs to see if any changes have been made. Your continued use of the Site after the changes have been posted will signify your acceptance of those changes.

Intellectual property
All information contained on the Site, including images, logos, photographs, illustrations, trademarks, texts, graphics, user interfaces, visual interfaces, sounds, music, and computer code (hereinafter the “Content”), and the arrangement of this Content, is the property of Safran ED or is subject to authorization for use. This Content is subject to copyright laws as soon as it is available on the Site.
No license or right other than the right to visit the Site is granted to the User.
No part of the Site or any Content may be copied, reproduced, modified, published, republished, downloaded, translated, transmitted, distributed without the prior written consent of Safran ED. If Safran ED agrees, the Content must indicate the mention “©Safran Electronics & Defense”. Notwithstanding the foregoing, copying information is permitted for personal and private use only.
Use of the Site
The User is solely responsible for his use of the Site. He is responsible for his behavior, and his actions. As such, Safran ED cannot be responsible for the consequences of the use made by the User of the Site.
The User must not use the Site or its Content for any purpose that is unlawful or prohibited by these GTCU, or to encourage any illegal or other activity that infringes the rights of Safran ED or third parties.
The User is not authorized to use any means to access, acquire, copy or monitor all or part of the Site, nor to obtain or attempt to obtain data, documents or information by hacking, or any other way through the Site.
The User shall not take any measure that would impose an excessive or unreasonable load on the infrastructure of the Site.
Accounts, passwords, and security
Use of the Site may require the creation of an account, including the configuration of a username and password. The User bears full responsibility to maintain the confidentiality of the information relating to his account, including his password, and all operations carried out under his account. The User undertakes to notify Safran ED immediately in the event of unauthorized use of his account or his password, or any breach of security.
Duration
These T&Cs are mandatory to the User as soon as he begins to use the services of the Site.
Guarantee
Safran ED will make its best efforts to ensure the accuracy of the information available on the Site. Safran ED does not guarantee the reliability, performance or completeness of the Site’s Content with the use that Users wish to make of it. Safran ED also does not warrant that the Site or its Content will be error-free or uninterrupted, that any defects will be corrected, or that the use of the Site produces specific results. The Site and its Content are provided on an ” as is ” and ” as available ” basis.
Safran ED does not warrant that files and data downloaded from the Site will be uninterrupted, error-free, or free of viruses, Trojan horses, contamination or malicious functionality. Safran ED cannot be liable for any damage or virus that could damage or render unusable the User’s computer equipment following a visit to the Site. Safran ED rejects all responsibility for the acts or conduct of third parties associated with the use of the Site.
Modification and discontinuance
Safran ED is subject to an obligation of means for the using of the Site by the Users. Safran ED reserves the right to do any of the followed actions at any time without notice:
(1) modify, suspend or block the access to all or part of the Site, for any reason whatsoever ;
(2) modify all or part of the information available on the Site ;
(3) modify all or part of the GTCU ;
(4) interrupt the operation of all or part of the Site temporarily, for periodic maintenance, technical interventions, error correction, updating or modifications. Safran ED cannot be liable in the event of interruption or suspension of the Site’s services. In any case, the resulted malfunctions and unavailability of services cannot give rise to any compensation for the User or any third parties.
Limitation of Liability
Safran ED declines all liability for any damage resulting in particular from an imprecision or inaccuracy of the information available on the Site or for any damage resulting from fraudulent intrusion by a third party on the Site with the intention to harm the interests or image of Safran ED, in particular by distorting the information available on the Site.
In no event shall Safran ED be liable to the User or any third party for any direct and indirect, exemplary, incidental, punitive or special damages, including any loss of revenue, loss of use, loss of profit, loss of profit, loss of contract, loss of opportunity, regardless of whether such damage was foreseeable, and whether Safran ED has been advised of the possibility of such damages.
If, notwithstanding the other provisions of these T&Cs, Safran ED cannot, under any circumstances, be held responsible for any damage or harm suffered by the User as a result of, or in connection with, the use of the Site.
Compensation
The User undertakes to indemnify and hold harmless Safran ED, its officers, directors, shareholders, predecessors, successors, employees, agents, subsidiaries and affiliates from and against any demand, loss, financial liability, claim or expense (including legal fees) resulting from actions from third parties against Safran ED due to or in connection with the use of the Site.
Jurisdiction
These GTCU are subject to French law, regardless of conflict law provisions.
Any dispute arising during the execution and/or the interpretation of the Contract will be subject to an amicable agreement. In the absence of agreement reached within a reasonable period of thirty (30) days, any dispute will fall under the exclusive jurisdiction of the competent French courts.
Any claim under these GTCU must be brought within one (1) year from the occurrence of the cause of action. After this period, it will be prescribed.
Content of the Site
In order to facilitate access to other sites that may provide additional information, Safran ED has inserted hypertext links into the Site. Safran ED formally declines all liability for the content of the websites to which these links refer. Safran ED cannot be liable for a third-party site to which the User have access via the Site and presenting contentious and inaccurate content.
In addition, external sites may contain hypertext links pointing to the Site. Safran ED has no legal means against this practice on the Internet and is not liable for content from external sites to Safran ED.
Protection of Personal Data
Each data subject has rights of access, rectification, erasure, limitation and portability as well as a right of opposition that he or she may exercise by contacting Safran ED’s Data Protection Officer: [email protected].
The data subject may also lodge a complaint with a personal data supervisory authority in the event of a lack of response or an unsatisfactory response from Safran ED. For the France, go to the website: https://www.cnil.fr/en.
Some of the personal data recorded on our server are those that Users as concerned person voluntarily provide when filling in online forms or when registering for services offered by Safran ED.
In order to improve navigation within its sites, Safran ED collects certain data during the visit via the deposit and reading of tracers called cookies that Users can set with the cookie settings available on these sites.

Confidentiality
Safran ED and the User undertake to keep confidential all information of any nature (technical, commercial, financial or other) to which they may have access during the User’s use of the Site.
The User undertakes not to disclose to third parties the information to which he may have access during the use of the Site, and shall not use these elements for purposes other than his current business with Safran ED.
Breach of these Terms of Use
The User agrees that Safran ED may transmit his information if such disclosure is necessary in connection with an investigation or complaint concerning the use of the Site. Safran ED reserves the right, at any time, to disclose any information deemed necessary to comply with law, regulation, legal process or government request.
Termination of the right of access to the Site
Safran ED may, at its sole discretion and without notice, terminate the User’s access rights to the Site and/or stop future access from the User to the Site (1) if it is determined that the User has not complied with these GTCU associated with the use of the Site, (2) at the request of a law enforcement agency or other public entity/institution, (3) at the request of the User (account deletion upon request), (4) in the event of interruption or significant modification of the Site, or (5) in the event of unexpected technical problems.
Diverse
These GTCU constitute the main agreement between the User and Safran ED for the use of the Site.
If any provisions of these GTCU are held to be void or unenforceable by a court, such provisions shall be limited or deleted, to the minimum extent necessary, and replaced by valid provisions that better express the intent of these GTCU so that they remain fully applicable.
In the event of a discrepancy between the information presented in the French version of the Site and the versions translated into other languages, the French version takes precedence over the other versions.
